Terms of Service

Important: These terms are provided as a draft and must be reviewed by a qualified solicitor before being relied upon as a legal document.


1. Introduction

These Terms of Service ("Terms") govern your use of the Let's Fish application and website ("Service"), operated by Trinnacle Software Engineering Solutions Ltd ("we", "us", "our"), a company registered in England and Wales.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. When you create an account, you will be asked to provide your date of birth to verify your eligibility.

If you are under 18, you confirm that you have obtained consent from a parent or guardian to use the Service.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorised use of your account
  • Accept responsibility for all activity that occurs under your account

You may register using your email address and password, or via a third-party authentication provider (Google, Apple, or Facebook). When using third-party authentication, you authorise us to access certain information from that provider as described in our Privacy Policy.

4. Subscription and Payment

The Service offers the following pricing:

  • Under 18: Free access to all features
  • 18 and over: £12.99 per year, with a 48-hour free trial

Subscriptions are processed through RevenueCat and the applicable app store (Apple App Store or Google Play Store). By starting a subscription, you authorise the relevant app store to charge £12.99 to your payment method at the start of each billing period.

Automatic renewal: Your subscription will renew automatically at the end of each billing period at the then-current price. You will be charged no more than 24 hours before the start of the next billing period. To avoid being charged for the next period, you must cancel at least 24 hours before it begins. You can manage or cancel your subscription at any time through your app store account settings.

Refunds are handled in accordance with the policies of the applicable app store. We do not offer refunds directly.

We will provide reasonable notice of any price changes before they take effect. Continued use of the Service after a price change constitutes your acceptance of the new price.

5. User Content

The Service allows you to upload content including photographs, trip reports, and other materials ("User Content"). You retain ownership of your User Content.

By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your User Content solely in connection with operating the Service. This licence does not permit us to use your User Content in advertising or promotional materials without your separate, explicit consent.

This licence terminates when you delete the relevant User Content or close your account, except that we may retain copies in backup or archival systems for up to 30 days following deletion.

You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not infringe the rights of any third party
  • Your User Content complies with these Terms and applicable law

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload content that is offensive, defamatory, or infringes the rights of others
  • Attempt to gain unauthorised access to the Service or its systems
  • Interfere with or disrupt the Service
  • Use automated systems or bots to access the Service without our permission
  • Misrepresent your identity or age

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Trinnacle Software Engineering Solutions Ltd and are protected by copyright, trademark, and other intellectual property laws.

The Let's Fish name, logo, and associated branding are trademarks of Trinnacle Software Engineering Solutions Ltd.

8. Third-Party Services

The Service integrates with third-party services including:

  • RevenueCat (payment processing)
  • OpenAI (AI-generated content features)
  • Amazon Web Services (image storage)
  • Google, Apple, and Facebook (authentication)
  • OpenWeather (weather data)
  • Geograph (location imagery)

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.

9. Disclaimer of Warranties

Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 or any other applicable legislation. In particular, we do not exclude implied terms as to satisfactory quality, fitness for purpose, or conformity with contract where such terms cannot lawfully be excluded.

Subject to the above, the Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.

Information provided through the Service — including fishing locations, weather data, and AI-generated descriptions — is for general informational purposes only. You should not rely on it as the sole basis for any decision, particularly regarding personal safety or the legality of fishing in any particular location.

10. Limitation of Liability

To the fullest extent permitted by law, Trinnacle Software Engineering Solutions Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

11. Termination

We may suspend or terminate your account immediately and without notice if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law.

Where we terminate your account for reasons other than breach, we will give you at least 30 days' written notice by email, and will provide you with a reasonable opportunity to export your User Content before termination takes effect. Any unused portion of a paid subscription period will be refunded on a pro-rata basis.

You may delete your account at any time through the app settings. Upon termination for any reason, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination — including §5 (to the extent of existing copies), §7, §9, §10, and §13 — shall continue in effect.

12. Changes to These Terms

We may update these Terms from time to time. Where changes are material, we will notify you by email and/or via an in-app notification at least 30 days before the changes take effect. We will also update the "Last updated" date at the top of this page.

If you do not agree to the updated Terms, you may close your account before the changes take effect. Your continued use of the Service after that date will constitute your acceptance of the updated Terms.

For users under 18, we will take additional steps to ensure changes are communicated clearly and that parental or guardian acknowledgement is obtained where required.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Alternative Dispute Resolution

If you have a complaint about the Service that we are unable to resolve through our internal complaints process, you may be entitled to refer your dispute to an alternative dispute resolution (ADR) scheme.

We are not currently a member of a certified ADR scheme. If you are a consumer and your dispute remains unresolved, you may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr or contact Citizens Advice for guidance on your options.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

17. Force Majeure

We will not be liable for any failure or delay in performance arising from circumstances beyond our reasonable control, including but not limited to acts of God, network outages, third-party service failures, or government action.
